H1b transfer, joining co. with approved labor...

Hi,

sorry for asking this question. but, can someone explain me what is 'H1b/VISA transfer' actually? What process it involves and how much time it takes? (plus what does it depend on?)

Also,
I got an opportunity to join a company which has approved labor (sate and fedral approved) with them. Can anyone tell me how easy it is? (I mean how will I be able to use that labor approval?), plus how much time it will take to file my 485 and other papers etc.?

You got the banana, which is already peeled off for you.

Changing the H1B is so simple, your new employer's attorney will take care of it.

Getting green card through approved Lab Cert is known as "Substituition of Alien". Same job category and salary, the attorney will get your I 140 approved first then go for I 485.

For I 140/ I 485 refer to your service center for waiting/processing time. (This site)

What if I a person has been on bench without pay for 4 months and then such compnay approach for green card.

Bench, no pay stub is nothing to do with this green card process. Even if you are in your home county, (never in USA), the same company approching you now, can file your green card. Green card is for future employment.
 
Be aware of the following:

1. You should have LC's educational and work experience requirements or better clearly before the date of filing (not approval) of LC. They are very strict about matching education/experience of applicant to LC.

2. Company (if small) may be asked to show ability to pay from date of LC application till present

3. If they have used the original LC for somebody's I-140 and are planning to withdraw the I-140 and apply again using duplicate LC, add about 1 year time for BCIS to get a duplicate LC from DOL

4. Make sure the company is solidly behind you if your GC application runs into bad weather

what if my new employer files green card when i am in USA on H1B but not received any paystubs or paychecks since last 7 months and also not aware whether ealier emplyer paid any tax or not.
