I am hoping somebody can help me out here.
I am an employee of Company A, my H1B sponsor.
I am working on a project for Company B, who is a client of A.
B offered me a full time position and willing to do a H1 transfer.
But I have signed an agreement with A before I joined the project.
The clauses in the agreement say
a) The employee cannot work for B through any other Agency.
b) If the employee intends to join B, he/she must take prior permission from A before joining B
Please advice, can i join B now?
I told A that I am joining B, but he says I cannot join at this time. I asked him to tell me a timeframe after which I can join B. But he says I cannot join B at any time, until he says so.
Is this fair? If I just ignore him and join B, can A sue me based on the above clauses?
