H1B transfer initiation

Hello all,

My 6 years of H1 B expired in Apr 2006 and extension was applied for in Nov 2005 and got it approved until April 2009. I have been with the same company all through. Now my employment with that company ends on Oct 2nd. I know that if H1B transfer is applied for by a new employer, I can start working for that employer. Do I have to wait to start working until I receive the transfer receipt? Can I apply for transfer after Oct 2nd?

What will happen to your GC, will old company going to keep it or cancell it

I can use AC21 now to switch employer. My I-140 is approved and I-485 is pending since 18 months.

So, what is the answer for my question? Can H1-B transfer be applied after the my last day of employment with my old company? Basically H1B be transferred after a gap of unemployment ( I did not leave the country and am on the status of AOS pending)?

If I were you,I would apply the H1B transfer right away and start working for the new company after employment is over with old company.you are still on non immigrant visa status and you have not paroled science you are working on H1B and gap of unemployment leads to out of status and If it is more than 180 days,your 485 can not be approved.
 
You can apply transfer immediately using portability rule. No need to wait any date.
