Hello,

Firstly, I am sorry if this has been asked before, I did look through this forum but couldn't find the answers.

I currently have an H1B visa that is valid until Jan 2011. My employer has just filed for bankruptcy but I have just secured another job with another company. My questions are as follows.

1. I have looked into fees for the H1B transfer but I'm unable to determine what needs to be paid and to who? Is the Anti Fraud payment of $500 still applicable for a transfer?

2. Do I just resubmit the same application as before but with the new employer information?

3. I have read that once I file the new petition and it is recieved that I can start with the new company, is this correct?

I am very grateful for any information that can be provided.

I-129 change of employer Filing fee of $320.00; ACWIA fee of $750.00 or $1,500.00 depends on number of employees; $500.00 anti-fraud fee
following are forms you are require to submit for change of employer
Form I-129 Petition for a nonimmigrant worker;
H classification supplement to form I-129;
H-1B data collection and filing fee exemtion supplement;
Labor Condition Application ETA 9035E; and
I-539 Application to extend/change nonimmigrant status (for spouse and dependent children)
you can start working for new employer once you have receipt in hand, this is covered under AC21 provisions

Sorry for the late reply and thank you very much for all of the information.

Could you also please tell me who are the checks made payable to?

Many many thanks!!
