I am currently in US with H1B from an major Indian IT firm.
I wish to transfer my H1B to a consulting company here in US. I am just wondering if my current company can force me to goto India if I tell him I am going to quit.
The reason why I ask this is because my deputation letter says that I continue to remain in the employment of their indian counterpart besides being deputed to US. It also states that i shoudl immediately return to India after my deputation in US.
Another question here,
My initial agreement with them also has a 1-2 month notice. If I go back to India and stay for a couple of months, can i then come back with the consulting company. Would that transfer come under H1B quota/cap?
If it is a transfer, please tell me if it is better to transfer it while I am in US or is it better when I am in India.
