Did my Masters from Aug03-Dec05.
H1B VISA from my previous employer XYZ is Valid from Nov-09-2006 to Nov-08-2009.
Filed for H1B transfer from a company ABC on April-23-2009 (Received date) and a notice date of May-06-2009 and I am working with them since then.
Previous employer XYZ applied for H1B revoke in May-2009.
For the H1B transfer, received a RFE(asking for client details) dated Aug-03-2009 and the response(given details about in-house project) was sent on Sep-03-2009.
"Denial decision notice" was the latest online status on Oct-13-2009 (On October 13, 2009, we mailed you a denial decision notice for this case I129 PETITION FOR A NONIMMIGRANT WORKER.)
Since last 3 weeks I am working with a new client and the project is for a six months contract to begin with.
Please give response to my concerns:
1. What would be my status now.(I was told that my Previous H1 is revoked and my VISA and I-94 is valid only till Nov-08-2009, another 20 more days to go)
2. What are my options now.
3. Shall I apply for a new H1 (rather than transfer) via premium processing from the same company ABC with details about the client/project where I am presently working or is it advisable to go to another employer.
4.Shall the company ABC go for Motion to re-open the case (MTR) and then submit the current client details, if so will I be eligible to work while the case is pending, if not can you please suggest me any other options like CPT,etc...
Please advice me and help me take a decision...
