H1B Transfer denied got RFE saying 6 years period is completed

Hi Members,

I am very bad situation please read and suggest me .

I have applied for H1B in Sep, 2000 through some consultancy company(A) and they processed my H1B

I lost my passport in Nov,2000 and applied for duplicate passport in Dec,2000 and i got the duplicate passport in May,16,2001.

My H1B papers are approved with company(A) in 2001 and i didn't go for visa stamping and dropped the plans because of the 9/11 and market down fall.

I joined with company(comp in India) in Dec,2000 worked up to 2002 October and i left it on Oct,2002.

I joined with company(comp in India) in Oct,2002 and worked up to May,2004 . I left it in May,2004.

I joined with company(comp in India) in May,2004 and applied for H1B through comp(B) in 2004. I got the H1B papers from this company(B) and attended consulate for visa and i got in Dec,2004.

I left IBM Global Services India in Jan,2005 and came to USA first time in my career in Jan,24,2005 through company(B) . I have valid I-94 up to Oct,2007 and Visa up to Sep,2007

I worked with company(B) for some time and transferred my H1B to company(C) in 2005 July and worked with company (C) up to Oct,2006.


I applied transfer to company(D) in Oct,2006 and got the RFE saying i have completed 6 years in USA with H1B and can't extend. It looks like USCIS is accumulating my time from the first H1B approval i got in Feb,2001 with company(A) up to Jan,2007. but i came to USA in Jan,2005 only. After that i never went back to my home country till now .

Please help me to answer to below questions

1 Can i go back to comp(B) and work because i have valid i-94 and visa i got from comp (B) first time? Is there any problem in the future if i go back to old company?

2. Am i legal to stay of i have valid I-94 and Visa with my old employer and if they did't revoked?

Please answer to the above questions and suggest me.

I think you need to reply for ur RFE first, otherwise ur visa gets denied and cant work anywhere. SO give proofs of your exit to India (Passport) and port of entry again (I94), he should reply for RFE 9need to involve ur employer D also).

I think u need to take attorney's advice whom can u work for in mean time(thinking it is C whom u left recently).
