My husband is a physician who had a waiver for the J-1 2-year visa requirement. He worked for company A for 1 yr 8 mths and due to unfair, unacceptable and poor working conditions he applied for a change of employer in the same underserved area. He started to work for Employer B once the petition for the H1B transfer was filed. Last week USCIS denied his petition to change employer due to lack of evidence and gave us 33 days to appeal. Question: can he still work legally with company B while all this appeal process is taking place?..Is there any point during all this process that he is not allowed to work?.
