H1B Transfer and H4 Status

Hi ,

I am transferring my H1 to a different company. I applied it today thru premium processing. My wife is on H4 here and her visa expires aug 2007 as per my existing H1b validity. She is planning to go to India next month. Is her visa valid or do we have to get her visa stamped again to get into US,now that i am leaving my ex employer. please clarify.

----- her H4 visa is Valid, H4 is not tied to employer A or B it is tied to your status H1, she can visit India and can enter on Valid H4 visa and she will get I-94 till August 2007 and she need to file H4 extension Before her new I-94 expiry date.

If you get your H1 approval notice and she is still in India then send her your H1 approval notice before she enter US and at POE she should show her passport with valid H4Visa AND your H1 approval notice and she will get I-94 till YOUR H1 approval notice( no need to file H4 extension as her I-94 expiry date will match with your I-94 expiry date)
