h1b tranfer pending -apply new h1b

I got layed off from a big company X and immediately applied for h1b transfer through company A.

I would like to know whether I can apply for a new H1 through company B in 2010 quota while my h1b tranfer from X to A is still pending.

Is there any risk involved? Please advice.
