H1B to marry US citizen next year- need info

Hi,
Could you please help me. I'm currently on H1B (expires June 07) in IL. I am engaged to a US citizen and we are planning our marriage for Sept of 2006. Can you tell me

1) Which forms do I need to file
2) When this needs to be done
3) Can I travel outside of US after the forms are filed? To visit home or or conferences?
4) We were planning to go back to my home town for our honeymoon right after the wedding ie the next day. Would this be possible? Will I be able to return to US after honeymoon on my H1B?
5) Can we file all paper work and marriage certificate AFTER the honeymoon?
6) When can we travel overseas again once forms are filed?
7) What visas, tavel authorisation approval do I need to be able to travel outside of the US?

Go to uscis.gov and check the faqs there. All your questions are answered there. You may also search this forum where others have answered this and other question. In general you both will file i130, i485 with you medical test and affidavit of support (i864) atleast. If you want to work while waiting for 485 approval, you will file for your EAD and if you want to travel you will file for your advance parole.
 
to save yourself time and ensure you have the latest info, just get all of hte reqs from USCIS's website.

I30, i485, i31(advanced Parole), i765(EAD). You don't need i31 if you're not going to travel until your GC approved.

2) When this needs to be done
After you got married because you need marriage certificate.

3) Can I travel outside of US after the forms are filed? To visit home or or conferences?

4) We were planning to go back to my home town for our honeymoon right after the wedding ie the next day. Would this be possible? Will I be able to return to US after honeymoon on my H1B?
You should be able to use your H1B until you filed your AOS

Yes, that what you should do.

Thanks everyone,

I guess what i really wanted to do was to get married, then go home to Australia to see family then when i get back to US (2 wks later) file the paper work. I was just worried about not following the correct procedure and being caught in customs!

Any other advice would be much appreciated :)

Do this. Get married. Travel to your home using your H1 B. Come back and then file for your GC, EAD and AP.
 
Will marriage licence cause complications?

So it will be totally legal to get married in US, leave country, return on H1B then file all paper work for GC after honeymoon? Will having the judge who marries us file the marriage licence interfer or cause complications to my return to the US?

Thanks so much! I just dont want them to refuse me entry when I return from our honeymoon.

You won't have any problem entering US since H1 B is a dual intent visa. You do not have any reason to worry about.
