Hi!

I joined a company A in october and they did a H1 transfer for me. Started working for them after I got the receipt. Later on I filed my GC and got EAD also.

Now USCIS has issued a RFE on H1. If they reject the H1 transfer for any reason, can I use the EAD to work for company A even though I got EAD in March and I started working for company A on the basis of H1 B receipt notice ?

What is the worst that can happen with this case ?

----- yes

----- if they recieve RFE details or documents then they will approve H1 if they are not satisfied with documents submited with RFE then they may not transfer H1, it seems RFE is for recent pay stubs from last employer when H1 transfet was filed. if they dont approve H1 transfer they may approve H1 with out new I-94 attached. if that happen then you can go out get H1 visa stamp and get H1 visa and enter on H1 status if you want to be on H1 status. you can also work on EAD. if I-140 is not approved and I-485 is not pending more than 180 days it is better to be on H1 status. if you go out of US for Visa stamp keep valid AP with you because if any problem with Visa stamp you can enter with valid AP and work with EAD. better reply the RFE for H1 transfer .
