h1b terminated, leaving US and re-entering with B1

Hello,

I was recently laid-off and my H1B visa was terminated on 11/26/08. I plan to leave the US on 12/14/08. I currently have a multiple entry B1 visa and was thinking of coming back to the US late January or February to try to find another job or apply for MBA or maybe take my CPA test. I was just wondering if coming back on a B1 visa with only a month gap from leaving the US on an H1B would cause issues?

I consulted two lawyers, one said I have to wait 6 months while the other one said I can immediately come back.

It all depends on the POE officer. He/she has the right to use his/her discretionary powers to determine whether you are a genuine visitor or not. Good luck!!!

I would suggest you to take a paid appointment with murthy.com and then take decision. In my situation, i had taken help of them got the correct advice which was different from my employer's attorney and the advice was in my interest.
Also , you can call up USCIS and ask them in details about your case.They can provide you accurate information..
