H1b start date

Are we allowed flexibility in H1b start date - later than Oct 1, 2008? My lawyer told me no, but I think she is wrong. Please, any pointers will be appreciated.

Also, there were plenty of hints in news articles that H1b cap for 2008 will be raised but does anyone know where to go for reliable info on the same? How much is it expected to be increased by this year?
 
If your OPT has remaining time, you can choose your H1 start date with special request.

Does the same apply if I am on EAD? For my previous H1b I had requesed and got Dec 1 as the start date but it was a cap-exempted visa. Does that matter?
