I have the copies of my old passport having F1,H1 visa stamp, copies of I-94,I-20 etc.

I want to know what are the chances of them asking for previous W2's.I was on bench for quite sometime in 2002.
------Dear at this time they can ask any document, they will need W2
In 2003 I tried to transfer my H1 but coz of complicated INS query I cudnt transfer so I went back to my old employer but since I worked for new employer I have 2 W2's for 2003.
----- I see a problem here. Does it mean you worked with new employer with out H1 transfer? You need to contact good lawyer
If the officer asks for all W2's since I was on H1, what should I say for the less salary in 2002 & 2 W2's in 2003.
------- Your employer has to write the reason on company letter head for less salary than approved LCA, if they paid less than LCA the employer violated H1law/regulation and can be investigated and also fined, it depend what reason they write on letter.
Also I'm Canadian resident so do you think, that saying I was in Canada
---- If you were NOT staying in Canada don’t try to lie, do you have proof that you were residing in Canada? Do you have apartment lease from Canada?? Don’t lie
& thats why the W2 in 2002 shows salary, will be a reasonable answer.
For Canadian residents they don’t stamp on passport while leaving/entering (atleast in 2002 it was like this).
------ YES through border they don’t stamp the passport but if you land by Air in Toronto they stamp the passport on entry some time.
*** Don’t try to lie, let your employer explain why they paid less than LCA. Apply the H1B with Bombay consulate and then only you will know what they are asking. Who knows you may be lucky to get H1 Visa with out problems. Same time be ready to stay in India for 2-3 months if they create problems became these days Bombay US consulate is also creating problems for H1 H4 visa stamps ( this is not to scare you I read many posts related to Bombay)
