I got my H1 extension last week and I am planning to go to India next month.
I am planning to get my visa stamped in Mumbai .
I have also applied for my GC and right now I am in 485 stage with my fingerprints due next week.
Now my question what to fill out on OF156 form for immigrant questions such as

Question 15
   Have you ever applied for US non immigrant visa
   Yes/No

   Have you ever applied for US immigrant visa
   Yes/No
   Where ----- When -----

Question 26
  Have you or anyone acting for you ever indicated to a US consular or
immigration employee a desire to immigrate to the US

I was told that once your H1 expires you can\'t extend it if you applied for the GC exactly because you are no longer qualified to be a "non-immigrant". Why did you do that in the first place? Why not EAD?

My company says that according to new law I can continue to be on H1 till the GC is approved.
Please tell me will it be a problem now for stamping or should I get my EAD now.

I think it may be because overseas embassies are very slow catching up with new laws and are much stricter. Why risk?

You can remain on H1, no problem at all. I\'m in a similar situation, I have remained on H1 and hoping to get my approval soon. What is OF156 anyway?

I renewed my h1 during 485 recently. And answered \'yes\' to question 26. H1 is a dual intent visa. But I renewed the visa in US.

I recently renewed my H1 while on 485, but that was inside US. My wife and kids renewed their H4 in Chennai while on vacation. We all answered yes to immigration intent. There was no problemat all.

We are in the same case.

I also applied for my H1 extension last
Nov 2000 and concurrently I also filed for
my GC last Oct 2000. My wife and daughter
already received their H4 extensions but
mine has not arrive yet.
  
May I ask when did you file yours? And
when did you get approval for your H1
extension?

Mine was filed in mid december and was approved in last week of february. It was filed in VSC.

Thanks for all your replies guys. I am in a very similar position as "H1BExt". I hope to apply at chennai for a H1 Revalidation. If i get it i\'ll use it to enter US, otherwise i shall use my Parole.

Should I also apply for EAD and take advance parole to go to India. Please let me know.
