H1B RFE...Urgent help needed

I got an RFE for the H1B petition filed by the company. Can I apply for new H1B through another company simultaneously while i am waiting for this RFE decision? I just want to keep another option so that I wont be in trouble even something wrong happens with this RFE. I cant wait until I hear the decision of this RFE because I don't know whether the masters cap is going to be available for another month or so. My attorney is going to reply to this RFE sometime next week. Even though mine is a premium processing, the RFE says that it will take atleast 1-2 weeks for USCIS to respond. So, I need to take a decision whether i can apply for fresh H1B with new company. Could someone please advise me regarding this matter?

How to answer this RFE question?

I need some expert opinion with regard to this RFE question:

1. How many individuals do the company employ in similar positions as Computer Systems Analyst? Of these, how many hold at least a baccalaureate degree? In what field of study? We are going to respond in this manner:

We employ more than 100 individuals in similar positions. All of our employees hold Bachelor or Advanced degrees due to the nature and complexity of the work we perform. Our employees hold degrees in various fields of study such as Mechanical Engineering, Electrical Engineering, Computer Science, Computer Information systems, Arts, Civil Engineering and Business Administration.

Will this be sufficient for answering this question or do we have to provide all the individuals details? Please someone advise me on this matter.

Reply answer in detail. They like detail answeres. It would be even better if you send them education evaluation of all employees.
 
I read that you can work for more than one employee with a H1b visa, so I guess you can apply for another H1b for another company, personally,my advise is, do it. Good luck

Congratulations!!!

Can you answere following questions:
1. Which service center issued a RFE?
2. How did you reply your RFE (By Fax or Post)?
3. Any LUD or message changed after you replied to your RFE but before approval?
4. How did you come to know about your approval (by your attorney, online status, email from USCIS)?

I have replied one of my RFE on July 25th but nothing has changed.

1. Vermont Service Center
2. By post
3. Online status changed on 7/29/06 that they received the RFE response.
4. My attorney received an e-mail from USCIS on July 31st around 2p.m about the approval. If it is a premium processing, I think they will send an email also. Mine is a premium processing only. The online status changed around 6p.m on the same day that the case has been approved.

I think if its a premium, then you will know it within a week after they receive your response. I don't know about the regular processing. Anyhow, I wish you good luck.

My case is at CSC that's why I guess it is taking more time.
 
Hi,

I am also in a pretty similar situation.. crossing fingers and waiting.. i applied for my H1B extension at Vermont and it seems to have been forwarded to CSC for processing, my employer received a query on 22 Jun 06 (the query was pretty long) and required the paper work to be sent by post rather than faxed. The lawyer confirmed that it was received by CSC on 31 Jul 06 and some one signed for it, Till date, 4th august the status has neither changed nor have the updated it that they have received a response to the query. This is a premium processing case, the check has been encashed but nothing is happening. I wonder how long it will take for them to give me a decision.

if any of you get a changed status in this time line please let me know.

I am ina similar kind of situation.......i have been issued an RFE by VSC.....

I would like to know if u had responded to the RFE in the manner as stated in ur post or did u elaborate on it ........Cud u plz give me an idea as to how ur response to the RFE was.

Got RFE today

Got rfe today , no idea what is it. this is 8 year ext, i94 expired on august 31st. labor still pending in PBEC..what a life?


Guys post your experience? what else we can do?
