I hope someone can help me with an advice.
My wife applied with premium processing for an H1B as accountant in Massachusetts and just received RFE that stated:
"the prospective employee's qualifications appear to be based on an occupation that may require a license for an individual to fully perform the duties of the occupation. Please submit the license or evidence from the appropriate licensing authority that no license is required."

My wife graduated a year ago with bachelors in BA and works for her sponsor company since then. She doesn't have a CPA license.

I'll appreciate if anyone here help us with some good advise.

Thanks anderson24,
My wife graduated a year ago and that's why she couldn't meet the requirements for a CPA License nor the 2 years of experience you're referring to, however.
Her boss took some time to research what other documents could be used to support the H1B request. He contacted the state board of accountancy via telephone and they confirmed verbally that she does not need to have a CPA license to hold a position as an accountant. However, they did not provide any official document stating it. So her boss wrote a letter in response to the Immigrations request in which he said that based on the duties of her position the state board of accountancy confirmed that no license is required and asked them to process her application as originally filed. So she did get an approval after the letter was submitted.

Hi xpu100, I hope you can receive my reply. I am encountering the same problem at this time. Just the same situation with your wife. May I have a sample letter that her boss sent to USCIS to have a general idea on how to reply to the RFE that I received this morning. I also called State Board of Accountancy, and they have verbally confirmed that only providing assurance service requires a CPA license to issue audit report. There is no need for an internal accountant to have a CPA license. Please help me on getting the sample letter that your wife s boss sent to USCIS. I truly truly appreciate your great help to me!!!! Did your wife get an approval of 3 years or just 1 year?

The letter should be done as any other oficial letter. Nothing specific.
Yes, you're right. There is no need for an internal accountant to have a CPA license.
My wife got a 3 years approval.
