H1B revalidation

I have a question about the time limitation on applying for visa revalidation in the US:

"A visa may be revalidated if it has a remaining validity of not more than sixty (60) days, or has not been expired for more than one year."

What is the compared date to the one year expiration date?
Is it the date the application is "received" in the St. Louis office?
The date the application is "processed" in the St. Louis office?
The date the application is "received" in the Washington DC office? or
The date the application is "processed" in the Washington DC office?

The stamped visa on my passport expired on Dec 25th 2001, but I have a renewed I-94 that has an expiration date of June 30 2004. I sent the renewal application to St. Louis last Friday (Dec 20th 2002), will I violate the dateline if it is received in the St. Louis office today (Dec 23rd) but not being processed until after the holiday?

Hi vera_id

We are in the same boat!

Will appreciate if someone please provides the answer.

Liberally the postal date of your application. Conservatively the approval date of the visa. St. louis has not been consistent. If you are waiting till 330+ days from previous expiry you are taking a risk and should not hope to fall through the cracks.
There is only one way to find out. Apply and see. Your I94 is preserved anyway.
Whatever answers you get share with this forum...

FYI (Jaxen)

Visa approved/Got my passport stamped.

I Think the process of adjudication starts at St.Louis .
