H1B Revalidation

Hi guys

Please help me
My H1 was stamped in May 2002 (with expiry April 04) in New Delhi India but I came in October 2003
Now this company filed my extension in March which got approved in June 21st for which I never got the I797 (or any kind of papers, I got to know about the approval by checking status online with EAC #)

Now without these extension papers I got my Visa transfered to some other company for which I have I 797

Now I need to go to India and got the revalidation done Please let me know if that is risky in absence of extension papers from my first company
I have those EAC no's with me but on requesting the status on phone they nowhave changed the message online to "Additional document required"

Also I have my education from India which is
BA ( 3 year degree course)
PGDCA ( one year correspondance diploma course in Computer Applications)

I have 5 years of IT experience and education credentials/evaluation done by my current country

Please advise

Looks Risky

Your travel to India looks risky based on the details you have provided below. In order to have no issues at a US Consulate in India, you need to carry all your prior approvals in case they ask. They may ask or may not ask, but you need to carry all your prior H1 approvals alongwith the LCAs and I129 petitions. Don't venture out of USA without all the required documents (Refer to appropriate thread in this forum for a comprehensive list of documents required for visa revalidation).
My suggestion to you is unless it is absolutely necessary for you to travel to India, don't venture out.

One more case missing papers

Hello GCOnly;

I am going to Tijuana, Mexico for 7th year stamping in March'06; I do not have my previuos employer LCA copy and Offer Letter; but I have Pay tubs and original I797; since 2.5 years I working with current employer; do you think it would be any issue while obtaining VISA at Tijuana, Mexico, I am going with my entire family (me, my wife and 3 kids)

Please let me know; any input highly appreciated.

I agree with GCOnly, you should have all your documents while travelling, even your previous 797s.
My personal experience has been that they look at your documents from current employer most of the time, but you never know when it comes to stamping. Sometimes they will not ask for anything and sometimes they will ask for everything.

I am in same situation as yours,I do not have LCA from one of my previous employer but I have 797, offer letter and pay stubs. I am working with my current company for 2.5 years now. I am just going to try and explain them (if they ask ofcos) that I do not have LCA bcoz my old employer did not gave me. But here are the letters, approval and pay stubs. I have appointment on Jan 30th in Mumbai and I am worried as hell. :(

I sent a email to my old employer..I know he is NOT going to send me those documents..rather he will think let this guy get into trouble...I left him bcoz of lack of pay...and was paying like I am working as a Manager in 99 cents store..so he didn't like that..he was very friendly with me in the initial stage..trust me one lesson I learnt in USA...never trust anyone when comes to legal papers and status..any now I am doom...let me explain you entire my story...

1.Came to USA with First employer....didn't able to find a job for me....transfered to another employer'''sometime Nov'2000
2.from 2nd employer I have all documents upto date...(valid till NOV'2003)
3.changed to 3rd employer but 2nd one still valid....(this is the one who didn't gave me LCA and offer letter documents...trust it was my bad I trusted him)
4.Didn't work for a while went for a marriage got married..came back
5.start working with no#3 and got pay for 4 months...since he didn't pay me well..I told him my project is over and sent my 2 time sheets to no#2 employer I got 2 pay check from no#2 employer since his H1-B was valid....till Nov'03 (filed H1 transfer to 4th Employer...) got 2 pay check from them as well..so I filed 2003 tax with 3 employers...#2,#3,#4
6.now with no#4 employer filed my Labor (Dec'2003); and working with them since Nov'2003; now I got 7th year approval as well, would like to go for a stamping to the third country.....working since 2.5 years....

Guys this my story...please let me if you see any issue while go for 7th year stamping..any input highly appreciated.

I am having same problem my old employer will not give me any papers. He is a small time consultant who just sucks everyone's money without giving anything back in return.
I left him in 6 months and I joined my current employer in Aug 2003. In Dec 2003 I went to stamping with my current employer without documents from my old employer and they did not ask me anything, I got away with it. Since I already have one stamping with my current employer I am hoping they wont ask me again about old LCA. I have 797, offer letter and pay stubs though. Hopefully everything works out fine.

Even I have my current employer H1-B stamping in my passport through St.Louis; even I travelled with same H1-B stamp; so hopefully they won't ask me anything....let's see please post your details as soon as you get it stamp successfully....
