H1B revalidation Refusal

I applied for H1B revalidation via mail in early June to State Department following the required procedure. I recieved back the Passport after 4 weeks, without new visa stamp. The Temporary Refusal sheet is checked "Other: Under existing guidelines, your application may need further processing at an American embassy outside the United States." At the bottom it says "we are unable to process because your application is not clearly approvable at this time. You must apply at an American consular office outside the US." Any thoughts why my application was refused, there is no obvious reason? Has this happened to others? Any changes in revalidation policies? I am a Pakistani National, my current H1-B visa stamp is expiring in December 2002 and my INS I-797 (new employer) has August 2004 validity.

Can I use Mexico Juarez border post for visa stamping? Is border post program is running as before? What about that recent change which allows 20 days waiting period before issuing visas. Does this waiting time is for new visa or revalidation also?

Confused, please help!
 
Shouldn't you need to wait till november 2002 ?

I might be wrong, But I think this will explain

A visa may be revalidated if it has a remaining validity of not more than sixty (60) days, or has not been expired for more than one year.


Wait till November and send back to them, Have you ever visited www.immihelp.com ? Follow the guied line and you should be fine.
 
h1 revalid refusal

The same has happened to me last week this month. I am a Bangladeshi married 2 children. My stamp already expired last August 2001. State department noted the same comment like you. I am ina confusion what to do.

Please reply me what are you doing? Do your stamp still valid? If valid, I think you could take chance to revalidate it from Canada or Mexico. In the extreme case if they refuse, you can still enter usa and stay .

I have not yet made up my plans on what i should be doing about this. still contemplating on a few possibilities.

stamp a visa for you, because you
are from Pakistan, High risk country,
second, if you are working
in one of those 16 technology alert
catagories, means that they will
do a security back ground check
on you if you go outr of state
after Dec 2002. If you go before that
time and return before Dec.
you will be ok. Seriously if you
go out of country like I did with a
expired visa on your pasaport,
you will be in trouble. Altough I
am a Turkish citizen, but because
of my natinality (IRAN) and the
type of job, molecular biology
I have been stucked here for 2.5
months now.
?f you like your job do not want to lose it do not leave US for now, or just invite your family to US
instead.

Are you still in Turkey? What they said finally on your He revalidation application?

As my application for revalidation was also being refused like hasan, should I still plan to travel Bangladesh on december. I am a softwere professional. Thanks- The usa
 
I think my earlier message was correct but it didn't go to right person.. FYI, krjeevan is NOT hasan.

I concur with what has been said before - it is just not worth taking a risk when visa expires unless someone's willing to get it stamped outside United States and is willing to face inherent risks in such an endeavour.

I am still holding on to my Visa with my H1 Validity way until Dec 03.
 
yes Dear, I am still in Turkey since
22nd of may.
I hope I won't get a refusal.
They did not say anything. As a matter
of fact many people from US tried
to help, even a letter from congrassman
did not help.

Why don' you check Harward university
immigration site. Just go to goggle
and type harward immigration.
It will give you a site a bout the definition of high risk, the catagories and
the processing time for security background.
they say the background chack takes 21 days, but it is a big lie.
One word. I would NOT go out of state.
