Presented below is my case.

1. I hold a valid H1B visa from my previous employer which is valid till Feb 2007.

2. I came into the US in Oct 2004 and was working for my previous employer till July 2005. I got my H1B transferred to a new company in August 2005 which is valid till August 2008.

3. My passport's validity is till Jan 2007.

Can I go to India on vacation during August or Spetember this year for a month and come back without having to get my or my family's passport stamped at the consulate in India? If yes, what all should I carry with me to gain entry into POE in the US?

if you have valid visa stamps in passports then you can come back to uS before the visa stamp expires, at POE show your new H1 approval notice and you will get I-94 valid till August 2008, if your family is on H4 status and they have valid H4 visa stamps then they can enter US if they come with you they can also get I-94 till August 2008(if they show YOUR H1 approval notice and valid visa stamp at POE) check your I-94 date and family I-94 dates at POE if any problems with I-94 dates ask for the supervisor or point out the mistake to officer

Thanks a bunch

Thanks So much..I appreciate it..

Just one more question..Could you please tell me what will happen if the previous employer with whom I have a stamping on my passport, cancels my H1B?

Will that create any problems?

-------------- the past employer can not cancell the the Visa stamp on passport that is under DOS, past employer can only cancell the H1b petition by writing to USCIS and USCIS dont stamp the Visa.
no problems, you have H1 approval through new employer

Pregnancy.

Thanks again for the super prompt responses.

I was told that pregnant people will not be allowed to board the flights during their last trimester?

Meaning, during the 7th to 10th month pregnant women are not allowed to board an outbound flight?

Is that true? Any Ideas??

--- check with Airline. One should not take risk of traveling with 7-8 month pregnancy. talk to your doctor and airline
