At http://travel.state.gov/hlop.html, its mentioned that we need to send the original or a photocopy of your current, valid Form I-797, Notice of Action.

I am thinking to send a certified copy. Did anyone send a copy or certified copy or its recommended to send the original I-797

Please advice

If original is asked for, why do you want to send a certified copy?

They are asking for either one Original or Photocopy. I just wants to know whether sending a certified or a photocopy will create any problem.

I have a similar confusion; they say "original or a certified copy of I94", and "original or a photocopy of I797". Is the use of two different terminologies intentional? And what exactly constitutes as a "certified" copy?

It is always safe to send original. If you send a copy, there is always a chance that they deny stating stupid reason as something is not clear on the copy. Even if you lose the original, your attorney can request another original from INS. INS will issue within 3 weeks.

I talked to a USCIS officer last week, happens to be related to one of my colleagues. His advice, staple the original I94 to the passport, send photocopy of I-797, and make copies of everything you send to the DOS.

He is not an officer of DOS so take it for what its worth.

---- USCIS officer is not lawyer and USCIS officer has nothing to do with DOS

---- I prefer to send orignal H1 approval notice and I-94, he is correct that one should keep the copy of all the documents sent.

That is correct, he is not a laywer, and neither is anyone else around here, for the most part. I mentioned that he is not related to DOS so use it as one more opinion from another quarter. For me, USCIS personnel's opinion carries some credibility, so I am going to send a copy of I797, and the original I94.
