Hi
I am sending my H1b for revalidation and had a doubt abt Q36 on the DS-156 form.

Q36. Has anyone ever filed for an immigrant petition on your behalf ?
Basically my co. has applied for my LC but at the same time, my husband has filed for 140 and 485 concurrent processing , and we got our EAD and AP also. Should I be saying Yes or No ?

Thanks , I appreciate an early answer.

--- if YOU are sending YOUR passport for Visa stamping then you have to write NO becase no I-140 was filed for you and I-140 is immigrant petition not LC

A small clarification here, if I-485 was filed for you too, then you will have to say yes, and explain the derivative relationship

question regarding revalidation

i am planning to send my h1b reval. packet. do we have to send original I797?
I would appreciate any quick response
thx

Thanks ! I finally decided to write No and added a note in the cover letter saying that a 485 has been filed for me as a derivative - my lawyer says that shd suffice.

I also sent the original 797 , because didnt want to take chances by sending a copy and having issues with it later.

I sent photocopy of H1 approval(that too, not certified) and I got my H1 stamped in 5 weeks from St Louis.
