My current h1B visa (& I-94) is expiring on June 18, 2009. However I need to go to Canada for PR landing (before 11 July). I have been suggested that I should avoid traveling out of the USA during the time when my renewal application is made.
Our company lawyer as told me that they will apply for my H1B renewal once I am back from Canada (which will be June 3).
My question is - What happenes if I do as suggested by the lawyer, and if I dont get the new I-797 before my current visa expiry? Will my status become invalid? Or is it that once they file for my renewal, then it is OK if the new I-797 comes after my current visa expires?
Any help will be very much appreciated.
