H1B Rejected after 911 - any insights here Mr.Jim

I have heard this from more than one source, that H1B\'s are getting rejected in the aftermath of 911.

INS is questioning employers about the requirements of the job, why they cannot find local talent and why do they need a foreign worker to do that particular job, what steps have been followed by the employer to find the local talent for the petitioned job - rejections are based on this.

Does the LCA approval guarentee a I-129 approval?
is it safe to work after the SRC receipt?

any insight\'s here will be greatly appreciated.

Its just frustrating who to choose, these days!

Rejections

I haven\'t had any H-1s denied. INS has always asked some stupid questions from time to time but I haven\'t noticed any increase.

LCA approval is a mere formality and certainly doesn\'t insure I-129 approval.

Is it safe to start working after the SRC receipt, if the H1B approval does not happen, what are the consequences.

Can the Law firm re-apply the H1b? or I have to pack my bags?
