H1b reapply

Hi,
I came to USA on F1 visa in Aug 2002. I completed my masters and OPT period and my h1b started in Nov 2005. after few months i cancelled it in April 2006 as i had to come back to india for personal reasons. now i want to reapply for my H1b. My questions are
1) If i apply now, will it count against the cap/quota?
2) if not, can i apply for FY 2007 or will i have to apply for FY 2008 and have my start date from oct 2007?

Once you have an approved H1B under your name, doesn't matter what status you are currently in, you can always reapply for H1b and your application doesn't come under quota. I know a friend you moved from H4->H1->H4, got the H4 stamped on her passport, then applied again for H1 while in US and got approval without any quota limits.
