H1B process and important dates questions

Hi everyone,

I am a Canadian who has moved in California since my boyfriend had a job opportunity in the financial business in Newport Beach under TN. As I do not qualify for the TN Visa or the L1 Visa my only chance to work is the H1B. I have a job opportunity arround here and they want to meet me to discuss the Visa issue. I want to be well informed about the process and the dates.

I read that we have to submit all the paperworks on April 1st of each year and they issue the H1B visa on October 1st. Is that correct? So the earliest I could begin to work would be on October 2007.

Also, it is written that they reach the cap of the H1B on 2½ months last year. Is that mean that if I submit everything by April 1st it is Ok and people who submit there application after mid-june they can`t get their visa?

I do not have a bachelor degree, but I have 5 years of relevant experience. With their conversion rules, I am OK. Is there any particular dates or rules that I forget and that I should mention to my company as it would be there first sponsorship?

Correct.

There are 2 types of H1 quota. One is regular H1, another is the one for those who got MS degree in the US. The former got exhausted at the end of May, so it took only less than 2 months, and the latter was exhausted about in 3 months this year.
if you do not have master degree from the US, you should expect quota will be gone fairly quickly.

In general, 3 year experience is converted to 1 year of degree. Your case has to go through credential evaluation, but it might be a little tough to get H1 with only 5 year experience. I'd recommend to talk to lawyer to evaluate your experience.
