I am posting this on behalf of my friend.
This is a very complex case, my friend was on F1 and then OPT. Found a consulting company that can sponser H1B. This company has applied for H1 in june 03, opt expires in july 03. They have some how screwed up the process and in october 03 they have recieved an RFE. The company is an indian company and is not willing to disclose the RFE but in turn assured that Change of status and H1B will be approved. in the month of Dec 03 upon pressing the company regarrding H1B they have replied that it has been rejected. And my friend had to leave US within 60 days.
In contrary the case status on the wesite says
as follows:
"On October 31, 2003, we received your response to our request for evidence or information. It is taking between 30 and 120 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case."
wih this situation and the employer not co-operating, the only option left is to get a H1 from another company while in India.
My question is
1. what is the possible status of the previous h1? and can it be followedup by other lawyers that did not file this case.
2. what documentation would be required for a new H1 that would be field from a new company. will they need the previous H1 case details?
3. To get an H1 approved what would be the best approach.
Please help...its very frustating.
