H1b or GC.....Can some please help me...

Hi,

Can some please help me. I am on J1 visa with 2 year & i have applied for my wavier now. If may waiver is approved Can i apply for GC on perm or should I apply for H1b 1st & then try for GC. cas by the time i get my waiver, I dont know if H1b quoto is available or not..

Note : I am not a software person. I am into Accounts.

2 years ago my uncle has applied my h1b in his CPA firm for an accounting job...& which was rejected.....but the INS was wrong..cas they thought that I have on degree in marketing, however i have on in banking.. I have my 3 years degree onluy..I dont have a PG..Now I am worried now..an i apply for h1b after my rejected or GC

Please I need help..can some one advice me ..

In principle you can apply for GC on J1 visa as long as you have waiver in place. In fact an employer can apply for your GC as a future employment as long as he can get LC done for you. Only trouble that occurs is if you are on J1 and apply for GC and if you have to go out of the country for visit and need to get your visa stamped, then consulate is likely to refuse the visa, since J-1 (your intial visa) was not "dual intent" visa i.e. immigration intent is not expected, versus H1-B which is dual intent. Recommended procedure is to get H1-B stamped on your passport and apply for GC. However, if you do not expect to go out of country till you have Advance Parole on I-485, you can apply for GC. I gues H1-B should be ok if you have have Educational qualification plus experience. Won't hurt to consult a lawyer, since I am not a lawyer

Try to get your CPA, PERM in place getting LC approved for accountant without a US degree or CPA is out of question.
