H1B Ninth Year, I-140 Appeal Filed, Please advise

Hello,
I’m currently on my 9th year of my H1B. I have applied for I-140 with a substituted labor (Priority date of 2004) and also applied for I-485, have approved EAD’s for myself and my wife, as per USCIS my I-140(filed in July 2007) got denied and my employer has filed for an appeal, I290B- appeal to a commissioner. I was told by attorney that appeal process takes about 12-18 months and it’s been almost 12months since we filed the appeal.
 What happens to approved EAD’s? they are valid up to November 2010. My wife was on H1B but, recently she got employed based on her EAD status.
Recently, couple of month’s back I was notified by my employer that labor with my beneficiary name has been approved with a priority date of 2007. Is it possible for me to go ahead and apply for a new I-140 under premium process? I also need to apply for H1B renewal this year by November 2009.

No one knows any appeal result. As a back up apply I 140 in premium and get approval.
