H1B mess

hi all,

Without the juicy details, here's the jist.
I started working for a company before they initiated h1b transfer.
I had been with the company for only a week before we both (employer and I) realized that was unlawful. During this time, I have not received any checks, no cash or any benifits from the company.

The company has filed for a premium processing for a NEW H1B visa now (POE application) and i am sitting at home. The countdown towards the 15 days began yesterday.

How grave is the situation?

Anybody ever been in this predicament before?

Would appreciate your insigths.

Do not worry at all enjoy ......if u haven't received any pay from your new empoyer...................
but u can start working right after u receive the receipt notice from uscis...u even do not need the approvel if it is a trnsfer case..................

Hi Par09,

Thanks for responding.
I started working even before i got the receipt notice.
The company applied for the transfer a week after i started working for them.
Hence the concern.

I am in a mess, am i not?

you are all right since you have not been paid yet....make sure they dont run payroll for that period...

The day i had posted my concern on this forum, i had received the "receipt number" and two days later, today, i received an email alerting that the case was approved. Amazingly fast!

I am leaving to the POE on labor day to get the new I-94 and i will fill in my experiences at the US-Canada border. I might be heading to the Detroit-Windsor POE.

If you have any tips for me, kindly share it.
