H1B Leasing in two different States and Filing GC through marriage

Hi Guys,

I am little confused and a novice here when it comes to GC filing, so please bear with me through long post

Here is my situation.

I am from India. Came to US in 2000 as a student, started H1B in 2004 and fell in love with a USC (born in india) that same year. We finally convinced both the families after a long fight and getting married next month. She is finishing her MD this month and got her residency in Duke in NC. I currently work in Washington DC

Now, we are planning to file for GC through marriage for me, in the month of July.

Here are couple of questions:

She is moving to North Carolina in June and will be leasing an apartment there. I would continue my job in DC and would be commuting every weekend to NC to live with her. I might even be able to convince my boss for an occasional work from home. So, we thought we should do the Joint lease for apartment, as I would really be living in NC atleast 2 or 3 days a week

But I would continue to maintain my apartment lease in Virginia where I live right now. So, does this create any issues for me legally, when it comes to H1B or GC or Taxes, if I have lease in 2 different states

Second, my employer is filing GC for me and they are about to file Labor very soon. Should I ask them to not proceed with the GC, since I would be filing through my wife anyway? I am thinking, its better to have it through employer also simultaneously just to fall back incase something happens. I have 19 more months left on H1B 6 year period

I do not want to sound alarming or anything but its always good atleast till the interview date to be staying together .If you look into these forums there have been cases which did not get approved at the time of interview similar to yours purely because of different locations of wife and husband. Their (USCIS's) idea is that 2 people should get married to stay together not to stay apart .. Is residency like full time school ? maybe your wife can give ur address as full time address ... Maybe the experts here will give u a better idea

Medical residency is basically full time training. And I will be living with the wife, but only for the weekends or may a extra day or two every week.

Since most of the apartment managements require you to be on the lease, if you are going to be living periodically like that, we were thinking we might as well put me on a joint lease . So, I am thinking, I can use North Carolina, where wife will be, as permanent address and my work place as temporary, as I really do have intention to move to North Carolina once I get a Job over there
