H1B Layoff...Time to Leave the US

Hello,

Just wondering weather someone could clarify this for me:

1) I just got layoff from my company and some people told me that I have 10 days to leave the country. Others tell me that I have 30 days. And still, others say that I have 180 days.

2) Some say that I have to fille for a change of status so that I can stay in the US for more than 10 days. Maybe change my visa to a B1. How do I do that?

I also have my I-130 (GC petition thru my parents) in process. Does that gives me the legal status to stay here?

Thanks,

Rob

1. It is generally time taken to pack and book a ticket. So 10 days is the norm. Anything more than 30 days you are inviting trouble. 180 days, for get about US for 10 years (if caught)

2. You dont have to, but you can
File I539
3. No I130 does not give you status. Once i130 is approved and if your IV number is available, then you can apply for 485/EAD/AP and be in status and not worry about any other visa.
