My husband is got H1b stamped in 2006 and came to US in June 2008. His visa expires in September 2009. In the meanwhile, he wishes to change his visa to L1b. If, after September 2009, he wants to go back to H1b, will he be subject to the 65000 cap? Does his company have to file a new petition? Will he have to leave the country and get a fresh stamping?
