Aloha,
Just to be clear, my H1B visa is expiring in Oct 1 2006 according to the visa stamped on my passport. Now is May. We had several attempts on PERM but because my attorney was so inexperience and my company was so slow in all the postings (poweful combination), it got rejected several times by different reasons (i.e. posting past 180 days, chose wrong options on the form...) My attorney thought that he would write an appeal letter and expected to receive the feedback with couple months. Until couple months later when I followed up with him, he called and found out that it will take months for the response because of thousand of appeals waiting in queue. So now we decided to redo all the postings, job order and prevailing wage. We post 2 sundays paper, campus posting, company website posting and internal referral program. These have been the things the attorney requires us to do. We should get them all done plus the job order by the end of June. Then we have to wait for a mandatory 30 days period before submitting the PERM again and so it will put me to end of July. My attorney told me that his last few clients took less than 2 months to get the result of the PERM. (I should have done more research on my own but these are the things my attorney told me). Let say if the perm app was approved by end of Sept. Where will I go? Do I still need to go back home for a year and have the company reapply H1B? Please advise.
