H1B is expiring and waiting for 140

Hi there,

I have a question. My H1 is expiring in July 2004 and I have an EAD also which is valid for one year(expiring in May 2005). My lawer says that I should renew my H1B. It will cost me around $1400 and I am not sure if I should renew it or not.

Could you please suggest me if I should renew it or not? I am thinking that renewal of EAD will not cost me more then 200$ then why should I renew my H1? If in case I loose my job, can I apply for a job at another place on the basis of EAD(though I am waiting for 140).

Any help would be highly appreciated.

Dont use EAD unless your 140 is approved. THat is the general recommendation that was made to me. I have continued with H1 extensions.
Even though it is more expensive it is safer route-- otherwise if you used EAD and 140 is denied, your entire period in which you used EAD is consideration in violation!
 
what about H4 Visa for my wife

I have another question. My wife has got her EAD then do we really need to extend H4 also what if I just extend my H1 and not H4 and keep her on EAD.
 
Renew her H-4 as long as she has not used her EAD. If she uses her EAD and try to renew H-4 you may end up with problems. Contact your attorney.
