I currently am an H1B holder in the state of TX, and am looking to move to NY. After looking at the various forum threads, I am under the impression that an H1B Transfer is to be done.
My current H1B was filed and received last August and hence is valid for a few more years.
However, my lawyer insists that a new petition for the H1B has to be filed by the new employer, and that the H1BTransfer process had been stopped altogether.
The position that is being applied for, that of a 'Computer Software Engineer - Applications' is different from the position my current employer had filed for - 'Computer Systems Analyst'.
1. Can an H1B Transfer be done in this case?
2. Since I am already on a valid H1B, I presume I would only have to wait for the notice of receipt from the govt. agency to start at the new place. Am I correct in this?
Are there any suggestions to get this process expedited?
