H1B-H4-greencard-spouse-please help

Hello all

I am currently on H1B visa and my company will soon apply for a greencard
on my behalf.

I am also planning to get married on December 25th, 2007. She is a Turkish citizen and currently resides in Turkey. She is then planning to arrive in USA sometime on August, 2008.

Can she still get an H4 visa while my I485 application is proccessing and make an entry to USA lets say sometime on August 2008. (Given that prior to her arrival my greencard application will be already submitted and she will be listed as a dependent on the application)?


What would be the best strategy to follow in this situation. My main concern is that after we get married and my greencard application is submitted it will be impossible for her to make an entry to USA on by August 2008.

Yes, she can get an H-4. Out of curiosity, in what EB category will you be filing under?
 
She can get an H-4 as long as you're in valid H-1B status. If you were to start working on EAD once you file your I-485, she can no longer use H-4 status. What time frame are you looking at when you'll submit the I-485? Have you considered the possibility that perhaps your AOS will be approved before Aug of next year? Then, she wouldn't come here on H-4 but use CP instead.
