Hi Guys,

Quick background: I’m on H1B Visa valid till May15, 2006 and I got my 7th year approval in Jan 2006. I wish to stamp the 7th year H1B visa either from Dublin, Canada or Mexico. I may have to travel to Ireland on a business visa and thought of getting the H1B / H4 visa stamped in US Embassy, Dublin.

Does anyone have experience to share on 7th year H1B visa stamping in US Embassy Dublin, Ireland ?.

In Canadian and Mexican US consulates, if you are denied a US visa for some reason, will they cancel the current valid H1B/ H4 Visas. In other words, should one have to go to India to get the visa stamp to re-enter US ?

Regards,
Josh

you may visit us consulates in canada at most 10 days before the start date on your new i797. and yes they willl cancel your prior h1b visas (sometimes even before the outcome of the visa interview is determined). not possible to re-enter the us afterwards unless visa is issued.

tusharvk, Thanks for sharing!.

My attroney had told me that they will not cancel the existing visa, if they cannot issue a new one. But, now I know she was wrong!...

Does anyone know this is the case in Mexican consulates as well. Will they also cancel the existing valid visa, if they cannot issue a new one.

One more question...... Does anyone know, if one travel back to USA on a valid H1B visa ( valid for another month) with new I-797 approval notice for 7th extension (valid till may 2007), will they give you the end date of new
I-797 as the expiration date on I-94.

My attroney had told me that if I use current visa to re-enter US, while I have the approval for 7th year extension, it would "kill"/ invalidate the 7th year extension approval and she may have to file for the 7th year extension again, before the exipration of current visa. Any one familiar with this issue?.

Regards,
Josh
