H1B -> Green Card -> Full time school

Hi,

I am on H1B at MD based company. I am on my 6th year of H1 and have my labor certification application at BEC. I am thinking of going to school full-time starting next fall (2007).

By the time I go on F1, I will have no time left on H1B. After finishing the school and an year of Optional Practical Training, will I will have to leave the country. what would be a good option for me to study full time with out affecting my green card application?

1. Can I work part-time on my current H1B, so that my green card application does not change? That way I can still go to school part time.

2. If not, then can I get a new part-time H1B, sponsored by the same company. But then I am not sure, what this will do to my green card application?

Thanks much!

Going part time should not be a problem for GC, as GC is for a future job (but a RFE may be flagged for GC since you probably will not be able to work full time when you get the GC -- depends on the CO).

I think (not fully sure), part time H1s are allowed, however they may deny the certification if they think that you may be a potential welfare seeker due to the reduced wages you will be getting due to working part time.
