H1b from Child to parent company-- IMP

I worked for company X1 till December 2001.I got laid off and took up a job with company X2.

Company X1 is a child -- a fullly owned unit of company X3 and calls itself as X1, a X3 company.

So i have a new job at the parent company X3 and my I129 says its for X1, a X3 company. So do i need a H1B transfer to X3 or can i work on my old X1 company visa for X3??

Also my H1 for X1 is still valid as i called the INS customer service automated line and verified it.

Please advise.This is urgent and Important.

I think you are fine. Maximum that might be required will be a h1 amendment. company lawyer should know.

Interesting... So did the automated message say that "your h1 is still valid" or was it just the original approval message still replaying?? Please clarify. There are many folks who would heave a sigh of relief to hear that they can verify whether their old H1 visa is still valid or not by a simple phone call.
 
The INS automated call line just said that, ur petition was approved on August 2001.

If my H1b was cancelled , the INS automated line would have said that.I believe so.The reason being , i have a old H1B from my first emplyer in the US .I quit that job in August 2001 and now when i call up INS automated line and key in that receipt no,it says Action was taken on H1B petition in September 2001 and a notice has been mailed to the address on the petiition(to my old employer) and that action was the cancellationof that H1B(confirmed by my old employer).

So i believe my this H1B is still valid bcose no action has been taken on it after the approval.
