H1B from an exempt institution

Hi,

I am currently a Master's student at a State University, under an H4
visa. I will be graduating this Fall with an MS degree. My
professor wants me to work under him to continue the research that I
did in my Master's program. He (and the school) are willing to
sponsor my H1B and pay me for my work after I graduate.

My questions are:
1) Are there any minimum salary requirements for a research position?
I don't think my prof will be able to pay a prevailing wages an
equivalent position in a private company would. Or is the prevailing
wage requirement not applicable to educational institutions?


2) Also, since this is a position in an educational institution, am I
correct in thinking that my H1B is not subject to the cap? Or is
there some list of institutions published by USCIS and the exemption
from the cap only applies to these institutions?

H1-b Cap

H1-b cap does not apply to h1 jobs offered by universities.However the question is if the university for this position will pay prevailing wages and are they planning to sponsor you further for a GC.

If this is a temporary situation then in the long run you have to consider further education or a new employer to get a new h1 for a GC.

Getting a job within an educational system is perhaps the best option one can get.

Thanks for your reply. Yeah the Univ is Ok with sponsoring the GC after my H1. However, the problem is the wages. Are there prevailing wage guidelines set for research positions in Univs?

My friend who recently got admitted to a post-doc position on H1b was paid much less than the prevailing wage in a company...so I don't know if there are different guidelines for prevailing wage within univs and non-exempt companies.

Can anybody help me with this question?
