H1B for new business

Dear all,

I am a British lawyer who recently passed the NY bar exam; 2 american friends and I formed a PC (professional corporation) and we are soon to file the H1B application for me; I wonder if the fact that ours is a new company with no sales so far and a share capital of only $100,000 will negatively impact in our petition.

I asked an immigration lawyer's opinion, he said he had never filed a petition like this but he saw no reason why should the application be rejected. Does any of you have knowledge or experience on a similar case? I did work hard to pass the bar exam and would like to practice in NY for a few years before returning to London.

I don't think the company has difficulty to get h1 visa simply because the company is new.

The difficulty is more on whether you can get H1 considering the fact all the H1 got exhausted on the 1st day of this year and they even had to go with lottery. The same thing could happen next year.
