H1B first time stamping

I have been in USA since 2.5 years now. I came on J2 Spouse visa and then got myself an H1B employer visa (non-research or medical). Im a hospitality industry professional. My H1B started in Oct 2007... I am now planning to go to India on vacation and will need to get the H1B visa stamped in my passport. Do you think there will be any problem for me... I heard that my people are facing problems and are getting delayed in India by 2-3 months due to security check/ background check...Is this true? What are my chances? I really need your advise.
 
Did you get a 2-year HRR waiver or was your visa not subject to the HRR rule? When doing AOS USCIS often forgets to check for the 2-year rule but consulates are usually on top of it.
 
USCIS is extremely particular as far as I know and never forgets to ask for the 2 YR waiver. And yes I did get my waiver. I have everything straight and legit...my only concern is that people are getting stranded in India for H1b visa stamping for want of background check by US embassy....All I want to know is whether its true or just hearsay?

Its certainly true that some people experience delays. There isn't much you can do about that. As long the J-1 is taken care of and your job is legitimate you shouldn't worry too much though. Thousands of people have no problems, only a very few do.
