H1b First time. Answers PL?

I got my H1b after my OPT from an Indian consulting company A.
about 10 months back. Have been on payroll since then. My company is only a body shopper, but has been in business long and close to 100 consultants.


My Questions are:

1. I am told that the job I do should match exactly with the job name mentioned in my H1b. Its says computer programmer,
But my job is more into testing, writing automation scripts. Will this be a problem?

2. How do I get copies of all my prior tax docs 1040's.

3. Do I have to take resume with me.?

4. I am planning to get stamping in Mexcio, instead of goingt o Chennai. ? Will there be any questions raised on why I came to Mexcio, instead of my home country.

5. What if there are delays in mexcio in issuing the visa. Will I be allowed to re-enter US & follwo up?

6. Worse case, if rejected. What sort of a contingency planning should one do? I dont even want to think along those lines. Is ther any grace period giving to re-enter US and wrap up?

@@@ basically you are a software engineer .. A software engineer can do programming and testing and whatever with software .. Better be tell you are software enginner any time

@@@CAll IRS they wil send you last three years

@@@ Where are you .. why dont you opt for canada also .mexico also good.. If you have good documentation that is enough ..

@@@ i heard somewhere in this forum that if you go to canada if you dont get a visa you have to go to home country only .. But i also saw somewhere in the fourms that mexico you can come back to usa.

@@@ you will get your visa .. Check the canada and mexico threads for more information ..Go with all the documetns .. adn pay slips and emplyyee letters and mainly your M.S.Certificates ..For you sure you willg et the visa ..

In your 6 th point you have mentioned employee letters. What is that? Do you mean a letter from my employer (i.e my consulting company.??)

I am in SC, and was thininking abt Mexcio, Cause I went there about 2.5 yrs back for getting my student visa extended.

I am told that they ask even technical questions on what ever you have put on the resume?

@@@ Yes a letter from your consulting company saying that you are drawing this much salary and you are good at unix and system admin and what ever you are doing in yoru client place and supporing you ..

@@@ no mostly they dont ask you this type of Questions .. I never heard that they are asking .. even they ask .. you can tell them in greek (:) means you can talk the software language .. thats not a problem ..
I am pretty sure that you will get visa ..

US consulate in Mexico

I currently researching my options for getting my H1-B visa stamped. I was also wondering about going to Mexico as i live in Texas.

Are you approaching any consulting agency to help you with the visa process? I read about "Mexico Immigration Consultants".. I wonder how good they are.

Also the Mexican Embassy Website states that we need to have the original "Change of Status" form with us. However that portion was kept by my employer and he gave me only the I-797 and the I-94. What are you doing about this?

Please help.

I am not sure what the i797 form is. my employer only gave me my i-94 & i think a receipt.

then he gave copies all all the other stuff. I 'll check and see if there is anythign called i797 or change of status form. FIY: I was previous on f-1/opt then got my h1b.

Let me know what all I should get from my employer.

I had been once to mexico through victor garcia to get my student visa renewed, I guess he would be my option. Not sure how much he charges now.

INS sends a change of status approval notice if you are changing from F1->OPT->H1B. This notice contains three parts (all in one sheet of paper). The upper portion is the status change notice. The lower left portion of the notice is I-797. The lower right portion of the notice is I-94.

From the employer you need to get the following documents.
1. I-129
2. LCA (With Original Signature)
3. I797, I94
4. And ofcourse an updated employment letter.

Hope this helps. Please keep me posted on the developments on your side. Can you please give me some more information about Victor Garcia? I am not aware of him.
