H1B- Few quick questions

Hi,

Need to sort a few things before getting into the thick of things. Any feedback/comments will be much appreciated.

1. Can there be 2 separate H1B applications from 2 different companies under processing at the same time. Also, will it be a issue if job descriptions are different?

2. If company A is asked to withdraw the application, are there any issues associated with the withdrawal (does it send a wrong signal to the INS). Is there a way to ensure that the company has withdrawn (Like a tracking number)

3. Will I be bound to work with the company B whose application was approved after Company A’s application?

4. At what stage do you get a confirmation that your visa will be approved? It takes about 3 months for visa receipt but is there a confirmation received prior to that date.

5. Is it mandatory to get the first stamping done outside the U.S? Is the home country a preferred way to do it?

3. Will I be bound to work with the company B whose application was approved after Company A’s application? If you are out side US you donot have any obligation until you enter US

Getting h1 approval is not a visa. Unless your home country US embassy issue a visa (in the pp) there is no guarentte that you are going to company A or B.It takes about 3 months for visa receipt but is there a confirmation received prior to that date.

5. Is it mandatory to get the first stamping done outside the U.S? YES , if you are out side US Is the home country a preferred way to do it? YES if you are not in US at the time of H1 approval/ or change of status

One more clarification

I am currently in the U.S and will start work with company B this month end or early June. Company A has already filed my H1B. I am expecting Company B to file sometime this month.

In this case, will it be a issue if I get Company B to do a premium processing. Someone had mentioned that I will be bound to work the company whose visa is processed at a later date. Is this true, considering the fact that I am here in the U.S.

And since I am in the U.S, where and when will I be required to get the first stamping done. Will I need to go back to India and since it is change of status (From F to H1B) are there any other restrictions to bear in mind?

Thanks
