I have an approved labor certification (approved on 3/5/08) and approved I-140 (approved on 9/20/08) in EB2 category. My current H1B is set to expire on 6/4/2009. I will not be able to file for I-485 until the visa bulletin date becomes my priority date (which is 1/24/08, when DOL received my application for labor certification).
I came in US on F1 visa on 8/14/1998, went to H1B effective 1/19/2001, stayed on H1B until 5/15/2002 and then went to F1 again (since 5/16/2002). I remained on F1 visa until (10/1/2005) for more than 4 years. Since 10/1/2006, I am on H1B again.
My questions are: does this reset my H1B years counter to 10/1/2005? When I apply for H1B extension, am I eligible for further 3 years extension or do I have to apply for 1 year only?
