My H1B is expiring on 4/30/2002. I applied for extension on 1/18/02 and it was approved till 1/2005.They have not issued I-94 card with H1 instead they mentioned Chennai consulate in that approval notice.

My questions are
1. Do I have apply for another extention.
2. what is my status after 4/30/02 with the current approved notice.
3. What if I don\'t apply for another extention.

Any suggestion in this regard is very much helpful.

thanks

No you need not apply for extension but...

Either INS thinks you were out of status sometime and so wants you to go to chennai consulate to get the new stamp
or INS made a mistake and thinks that you requested a consular notification instead of I94.
Ask your lawyer. If it is a mistake on INS part, you could get some relief. Otherwise you have to go to chennai consulate to get the visa stamp. Your status will expire on the current I94 expiry date.

Why were you issued an approval notice without I-94s? Four possibilities -

1. INS believes that you are/were out of status for a period of time and therefore did not extend your status.

2. INS made a mistake and issued the wrong approval notice.

3. Your attorney made a mistake when completing the I-129 petition and did not request EOS.

4. You are looking at the employer\'s courtesy copy of the approval notice, not the real approval notice.

2 time Rescheduling

Hi,
I recd my finger printing notice on Feb 11 for march 6th. I was out of country so had to re-schedule it. I got a new date may 18th-- can i re-schedule it again?
I might be out of the state on that day.
are there any limits on how many times can u postpone the finger printing.
I have recd the same exact letter-- it does not say this is ur last chance or something like that.

You could

do your FP earlier too.
I think you can postpone it couple of times more. But you cannot keep on postponing it. Third time you might not get lucky.
