My HR says that one has to till four months before the expiry of the H1B visa (the first three years), to apply for the first extension. Is this true?? I have heard cases otherwise. Also, where can I find written proof of the non-existence of such a rule??

-- HR is providing you wrong Info, you can file for H1extension any time before your Valid I-94 expiry date, your extension papers should reach BCIS before I-94 expiry date, you can file 4 days advance of H1 expiry/ I-94 expiry, your papers should reach BCIS before your I-94 expires. H1 extension is taking 4-6 months at this time to be approved, but once you file before expiry date you will be in status

Go to BCIS site and read the Extension of Nonimmgration status, your company lawyer knows every thing ask him/her
 
I believe you cannot apply 6 months before the extension date. (If the h1 application is for extension from july 1st, you cannot apply before January 1st) But your application should be FILED before the expiry of h1.
