My HR says that one has to till four months before the expiry of the H1B visa (the first three years), to apply for the first extension. Is this true??
-- HR is providing you wrong Info, you can file for H1extension any time before your Valid I-94 expiry date, your extension papers should reach BCIS before I-94 expiry date, you can file 4 days advance of H1 expiry/ I-94 expiry, your papers should reach BCIS before your I-94 expires. H1 extension is taking 4-6 months at this time to be approved, but once you file before expiry date you will be in status
I have heard cases otherwise. Also, where can I find written proof of the non-existence of such a rule??
